Dear Sir,
We beg to confirm our telephonic conversation with you this morning relative to the further charge amounting to £37.12. 4. passed to you with ours of the 27th instant, in respect of Foodstuffs shipped by s.s. HARTBRIDGE. We have examined our correspondence and should like to point out that your order was placed with us on the 10th December by telephone, and was based on the information you gave in your letter of the 9th December. In confirming the order in ours of the 10th December, we indicated that the order had been placed with our various Works and gave you prices at which the bookings had been effected. Admittedly, in our postscript we intimated that our prices would cover the cost of insurance, and in effect represented c.i.f. values, but we did not intend to imply that these were firm c.i.f. quotations. Indeed our experience has shewn that it is quite impossible to give c.i.f. quotations for shipments to Spain at the present time. In fact, you will know that steamers chartered by the Spanish Government are scheduled to load from time to time at various United Kingdom ports, but very rarely do they actually sail on the date originally given. Consequently, demurrage is frequently incurred and this was the case in connection with the HARTBRIDGE consignment.
The vessel should have loaded on the 14th December, and our goods were accordingly delivered alongside on this date. Unfortunately, following a dispute
